PEEL’S TERMS & CONDITIONS

Please take a moment to read these online shopping terms and conditions (T&Cs) to understand how they apply to your online purchase of any products and to the use of www.peels.co.za (the website). If you have any questions regarding the T&Cs, products or the website, please click here to contact us. By visiting and using the website, you acknowledge that you have read and understood these T&Cs and agree to be bound by them. 

  1. PRODUCTS, SALES AND AVAILABILITY OF STOCK
    1. The website offers for sale various honey, honey-related products, confectionary products and Peel’s associated merchandise (together the Products).  
    2. Your offer is deemed to be accepted when you receive an order confirmation. Risk in the Products shall pass to you or your authorised representative on delivery. We will retain ownership of the Products until payment is received in full. We reserve the right to refuse to service anyone for any reason at any time.
    3. In general, Products are delivered within seven business days and will only be delivered within South Africa. We have outsourced all delivery and collection arrangements to third party service providers. Accordingly, we cannot, to the extent permitted by law, be liable for any loss or damage caused by them.
    4. After delivery of the Products ordered, you may return Products only in accordance with the Returns Policy set out in paragraph 6 of these T&Cs.
    5. All Products displayed on the website are subject to availability. We reserve the right to discontinue or change the specifications of our Products from time to time without notice. We will inform you as soon as possible if any Products ordered by you are not available and you will be entitled to a refund of any amount already paid by you for such Products or a gift voucher as agreed with you at the time.
  2. PRICING
    1. You will be charged the prices that are reflected on the website subject to availability and delivery address. The prices include VAT. 
    2. Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. 
  3. GIFT VOUCHERS
    • Peel’s gift vouchers are not redeemable for cash and will not be replaced if lost, stolen, destroyed or used without permission. Peel’s gift vouchers cannot be resold to or exchanged with a third party.  Peel’s gift vouchers can only be redeemed online through the website (www.peels.co.za).
  4. INTELLECTUAL PROPERTY RIGHTS AND USE OF THE WEBSITE 
    1. All rights, including copyright, trademark and other intellectual property rights embodied in any logos, text, images, video, audio or other material on the website are owned by or licensed to us. Unauthorised use, reproduction, modification and/or distribution of the content thereof is strictly prohibited and constitutes an unlawful infringement of our intellectual property rights.
    2. The unauthorised use, copying, reproduction, variation, modification or distribution of the content of the website, the uploading of any unlawful or damaging information or viral software or the creation of any links to the website is strictly prohibited. You agree to indemnify us against any loss, damage, harm, claim or any other cost whatsoever that we may sustain as a result of your use of the website contrary to these T&Cs.
    3. We reserve the right to suspend the use of the website or any part thereof or terminate your account at any time if we, in our sole discretion, determine that you are not using the website in compliance with these T&Cs or if we believe the information provided by you is untrue, inaccurate or incomplete.
  5. LIMITATION OF LIABILITY
    • Use of the website is entirely at your own risk. We make no representations or warranties of any kind, whether express or implied. We accept no liability, to the extent permitted by law, for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused arising from the access or use of the website or the purchase of any of the Products. You agree, to the extent permitted by law, to indemnify us against any loss or damage suffered or liability incurred by reason of any act or omission on your part or that of any third party acting on your behalf in connection with your use of the website and/or your purchase of any Products.
  6. RETURNS POLICY – Peel’s accepts returns from users who have purchased Products from the website if:
    1. Products are found to be defective; or
    2. Products are found to be unsuitable for the purpose for which they were intended based on the purpose communicated by us to you at the time of purchasing the relevant Product.
    3. For the purposes of the Returns Policy, defective means (i) the packaging of the relevant Product is materially damaged; or (ii) the relevant Product is beyond its sell-by date on the date of delivery. 
    4. Kindly contact us should you wish to return any of your Products on the basis set out in this paragraph 6 of these T&Cs within 10 business days of receipt of your Product. 
  7. PRIVACY
    1. Peel’s will take all reasonable steps to protect the personal information of users. For the purpose of this paragraph, “personal information” shall have the meaning given to it in the Promotion of Access to Information Act, 2000. 
    2. By using the website, users hereby consent to letting us process personal information for the purposes of sending information, keeping users up to date with customer trends and improving customer experience.
  8. TRADE BUYERS
    • The T&Cs set out in paragraphs 1.3, 2.2 and 3 do not apply to Trade Buyers. 
  9. GOVERNING LAW AND DISPUTES
    1. These T&Cs are governed by, and all disputes shall be resolved in accordance with the laws of South Africa.
    2. The parties irrevocably submit and agree to submit to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Local Division, Johannesburg in respect of any disputes arising in relation to these T&Cs.
  10. UPDATING OF THESE T&CS –
    • We may periodically update or change these T&Cs without notice.  You should check them from time to time as your continued use of the website will mean you accept any updated or revised T&Cs. 
  11. GENERAL
    1. These T&Cs are the entire agreement between us and you with regard to the use of the content and the website.
    2. Any term that is invalid, illegal, or cannot be enforced must be regarded as deleted. The remaining terms continue as intended.
    3. If you are under the age of 18, you may not respond to or otherwise accept or act on any offers on the website.
  12. CONTACT INFORMATION AND NOTICES
    1. This website is owned and operated by Peels Holdings Proprietary Limited in South Africa (trading as Peel’s) with registration number 2016/325211/07.
    2. Any communications in terms of these T&Cs (including without limitation any notices, requests and demands, legal process) shall be sent to Peel’s at its address Unit 23, Hilton Business Park, 6A Quarry Street, Hilton, 3245.
